Am 13. März kam es in Frankfurt bei der EFAF Generalversammlung zum Eklat. Der niederländische Verband wollte seinen damaligen Schatzmeister Harry van den Boogaard als Kandidaten für die Wahl zum EFAF Präsidenten aufstellen – eine Gegenkandidatur zum Amtsinhaber Robert Huber (GER), der sich für eine weitere Amtszeit zur Wahl stellte.
Kurz vor der Versammlung tauchte bei der EFAF ein überraschendes Austrittsschreiben des niederländischen Verbandes auf. Trotzdem die Delegierten aus den Niederlande das Schreiben vor Ort als plumpe Fälschung bezeichneten (Sie hätten es nicht verfasst, es sei weder ihr Briefkopf, noch ihre Unterschriften darauf), sie also nie ausgetreten wären, ließ man die Delegation bei der Sitzung nicht zu. Als sie trotzdem teilnehmen wollten, drohte man ihnen nach eigenen Angaben mit Polizeigewalt. Somit war Huber der einzige Kandidat für die Präsidentschaft und wurde auch wiedergewählt.
Danach begann sich der Weltverband IFAF für die Geschehnisse bei der Frankfurter Versammlung zu interessieren. Im Oktober des letzten Jahres stellte IFAF Präsident Tommy Wiking (SWE) dann schließlich fest, dass hier nach Auffassung des Weltverbandes Rechte seiner Mitglieder verletzt wurden, die Vorgehensweise (Ausschluss aus der Sitzung) verstoße außerdem gegen die Statuten des Verbandes und gegen deutsches Recht. Die Sitzung solle wiederholt werden, so eine der Forderungen der IFAF an die EFAF.

Über die Antwort der EFAF auf das Schreiben ist uns inhaltlich nichts bekannt. Falls es überhaupt eine gab, dürfte sie aber nicht für alle Mitglieder zufriedenstellend gewesen sein, denn nun prescht der dänische Verband mit drei Tagesordnungspunkten für die kommende Generalversammlung am 27. März 2011 vor.
Drei Dinge will der Dansk Amerikansk Fodbold Forbund (DAFF) behandelt wissen.
- Misstrauensvotum gegen den EFAF Präsident Robert Huber.
- Abstimmung über einen Widerruf der Ernennung von Robert Huber zum EFAF Präsidenten.
- Wahl eines neuen EFAF Präsidenten für die restliche Amtszeit von drei Jahren.
Begründet wird das seitens der Dänen mit fehlenden Antworten auf Fragen zu eben den Ereignissen bei der Generalversammlung von Frankfurt im Vorjahr. Diese seit fast einem Jahr offenen Punkte führten beim dänischen Verband zur Schlussfolgerung, „dass Herr Huber weiß, dass die EFAF Statuten verletzt worden sind und dass der niederländische Antrag gefälscht wurde“. Für sie gäbe es „keine andere wahrscheinliche Antwort“. Das Vertrauen in den EFAF Präsidenten sei daher erlöscht.
Die kommende EFAF Generalversammlung kann man also mit Spannung erwarten, denn die Sache hat auch einen veritablen logischen Haken. Warum würde ein aus der EFAF ausgetretener Verband trotzdem noch seine Delegierten zu einer Generalversammlung schicken und bei Wahlen antreten? Eine von vielen offenen Fragen zum Thema.

Dear Sirs,
We hereby request – in accordance with Article 5 para. 6 of the Statutes of EFAF- that the following items should be included in the agenda for the EFAF General Asembly (“GA”) at March 27th 2011
1. Vote of no confidence for the EFAF President Mr Robert Huber.
2. Vote for the revocation of Mr. Robert Huber’s appointment as President of EFAF.
3. Election of a new EFAF President for the remaining term of 3 years.
Short presentation of the reasons for the above:
Due to the lack of response to our questions regarding the events that took place before and during the EFAF GA 2010 we have no other option than to call for a vote of no confidence for the President of EFAF, Mr Robert Huber. Before the 2010 EFAF GA a false request for terminating the membership of the American Football Bond Nederland (hereinafter “AFBN”) in EFAF was approved by the EFAF Board of Directors. This decision was made in spite of the fact that such decision was in clear breach of the EFAF statutes. Article 24 of the Statutes of EFAF provides the following:
"A member association wishing to withdraw from EFAF shall notify the Board of Directors accordingly by registered letter. The letter shall include the minutes from the general assembly of the member association that decided to withdraw from EFAF."
None of these provisions were fulfilled by the letter allegedly sent by AFBN, as it had been falsified and was neither send by registered letter nor did it include the minutes from the general assembly of the AFBN proving a decision about a withdraw from EFAF (because there never had been any such decision). Furthermore, the two legal representatives from AFBN, that allegedly signed the letter were present in Frankfurt and denied that they had signed or send such letter and that such request ever had been made. The actions by the EFAF BoD and the EFAF disciplinary committee that prevented the two representative of AFBN to even present their case in front of the EFAF GA 2010 was clearly done with one purpose, to make sure that Mr Huber faced no opponents in the elections. One of AFBN’s delegates had expressed his candidacy for EFAF Presidency, which was known to Mr Huber.
We have asked for an explanation but we have never received any answer, that deals with the matter. Our conclusion can only be that Mr Huber knows that the EFAF statutes have been breached and that the Dutch request had been falsified and that there is no other probable answer. The confidence for Mr Huber as EFAF president is erased and the appointment of Mr Huber as President of EFAF should be revoked by EFAF’s General Assembly in accordance with Section 27 para. 2 German Civil Code.
